Der Kommentar zum Arbeitsgerichtsgesetz (ArbGG) ist eine kompetente Arbeitshilfe zur Beantwortung verfahrensrechtlicher Fragen im Arbeitsrecht, die auch wissenschaftlichen Ansprüchen genügt. Er enthält ausführliche Darstellungen zu den arbeitsrechtlichen Verfahren vor dem BVerfG und dem EuGH sowie dem Einigungsstellenverfahren. Neben der aktualisierten Rechtsprechung und Literatur wurden folgende Gesetze neu eingearbeitet: Tarifeinheitsgesetz Gesetz zur Einführung der elektronischen Akte in der Justiz und zur weiteren Förderungdes elektronischen Rechtsverkehrs 6. SGB-IV-Änderungsgesetz Bundesteilhabegesetz Gesetz zur Sicherung der tarifvertraglichen Sozialkassenverfahren und zur Änderung des ArbGG Neu aufgenommen sind die wichtigsten Besonderheiten aus jeweils beiden Instanzen des Prozessverfahrens vor den Gerichten der kirchlichen Arbeitsgerichtsbarkeit. Eingehend erläutert sind alle wichtigen Themen der prozessualen Praxis einschließlich der Bezüge zur ZPO.

The founding of a constitutional court is often an indication of a chosen path of constitutionalism and democracy. It is no coincidence that most of the constitutional courts in East and Southeast Asia were established at the same time as the transition of the countries concerned from authoritarianism to liberal constitutional democracy. This book is the first to provide systematic narratives and analysis of Asian experiences of constitutional courts and related developments, and to introduce comparative, historical and theoretical perspectives on these experiences, as well as debates on the relevant issues in countries that do not as yet have constitutional courts. This volume makes a significant contribution to the systematic and comparative study of constitutional courts, constitutional adjudication and constitutional developments in East and Southeast Asia and beyond.

"Recent confrontations between constitutional courts and parliamentary majorities, for example in Poland and Hungary, have attracted international interest in the relationship between the judiciary and the legislature in central and eastern European countries. Several political actors have argued that courts have assumed too much power after the democratic transformation process in 1989/1990. These claims are explicitly or implicitly connected to the charge that courts have constrained the room for manoeuvre of the legislatures too heavily and that they have entered the field of politics. Nevertheless, the question to what extent has this aggregation of power constrained the dominant political actors has never been examined accurately and systematically in the literature. The present volume fills this gap by applying an innovative research methodology to quantify the impact and effect of court's decisions on legislation and legislators, and measure the strength of judicial decisions in six CEE countries."
